By accessing or using MagicMe Stories ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

MagicMe Stories is a personalized storybook creation platform that uses artificial intelligence to generate custom illustrated stories featuring your family members. The Service includes:

• Character photo upload and management
• AI-powered story generation with personalized illustrations
• Professional narration and background music
• Story viewing, sharing, and export features
• Subscription and credit-based payment options

3. Account Registration

To use the Service, you must:

• Be at least 18 years old or have parental/guardian consent
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account.

4. Subscription Plans and Billing

4.1 Subscription Tiers

We offer the following subscription plans:

• Starter Magic (Free): 1 story per month, basic features
• Little Dreamer ($9.99/month): 5 stories per month, premium features
• Magic Family ($19.99/month): 15 stories per month, all features + priority support

4.2 Story Credits

Story credits can be purchased separately and do not expire. Credits are non-refundable once used to generate a story.

4.3 Billing and Renewal

• Subscriptions automatically renew monthly unless canceled
• You will be charged at the beginning of each billing cycle
• Monthly story allowances reset at the start of each billing cycle
• Unused monthly stories do not roll over to the next month
• Price changes will be communicated 30 days in advance

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period you've paid for.

5. Refund Policy

• Subscription fees are non-refundable except as required by law
• If you're unsatisfied with a generated story, contact support within 48 hours for a credit refund
• Unused story credits are non-refundable
• Technical issues preventing story generation will be resolved or credited

6. Content Ownership and License

6.1 Your Content

You retain ownership of all photos and information you upload. By uploading content, you grant us a limited license to:

• Process your photos to generate personalized story illustrations
• Store your content securely to provide the Service
• Use your content solely for creating your personalized stories

6.2 Generated Stories

You own the personalized stories created for you. You may:

• Download and print your stories for personal use
• Share stories with family and friends
• Use stories for non-commercial purposes

You may not:

• Sell or commercially distribute generated stories
• Claim AI-generated illustrations as your own original artwork
• Use the Service to create content for others commercially

7. Acceptable Use

You agree not to:

• Upload photos of individuals without their consent
• Create stories containing inappropriate, offensive, or illegal content
• Use the Service to harass, abuse, or harm others
• Attempt to reverse engineer or copy our technology
• Share your account credentials with others
• Use automated tools to access the Service
• Violate any applicable laws or regulations

8. AI-Generated Content Disclaimer

Our Service uses artificial intelligence to generate stories and illustrations. While we strive for quality:

• AI-generated content may occasionally contain errors or inconsistencies
• Illustrations may not perfectly match uploaded photos
• Story content is generated automatically and reviewed for appropriateness
• We do not guarantee specific artistic styles or outcomes

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. We take data protection seriously and comply with applicable privacy laws including COPPA for children's data.

10. Intellectual Property

The Service, including its design, features, and underlying technology, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our permission.

11. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the past 12 months
• We are not responsible for third-party service failures (AI providers, payment processors)

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination:

• Your access to the Service will be revoked
• You may download your stories within 30 days
• Unused credits and subscription fees are non-refundable
• Your data will be deleted according to our Privacy Policy

13. Changes to Terms

We may modify these Terms at any time. Significant changes will be communicated via email or website notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which MagicMe Stories operates, without regard to conflict of law principles.
